Social Host Liability & Responsibility
|
Keep your Family & Guests Safe
Did you know...........??? 50 percent of all traffic fatalities are alcohol related?
A sobering thought if you are hosting or attending a party this year!
If your guests get into an accident because they had too much to drink at your party, the finger could be pointed at you.
The best solution ....................................... have a dry party filled with specialty drinks & foods.
Don't let too good of a time spoil "Your Event"
What does the Law State?????
The social host holds the responsibility to ensure that no "foreseeable" harm occurs to the guest because of serving alcohol and fails to do take preventative steps
Legal Implications and Possibilities
1. Being sued by your guests insurance company due to injuries with personal damage. 2. Your guest may sue you for injuries resulting of the intoxication. 3. You may be sued if you were aware that your guest was intoxicated and you did nothing 4. In addition to civil liabilities for damages and/or injuries, criminal liability can exist where a parent or non-parent serves alcohol to a person under 21 years of age.
Preventative Measures
- Provide unique non-alcoholic drinks such as Espresso, Latte', Cappuccino, Tea
- Encourage lively conversations and group activities that focuses on fun and not alcohol.
- Never serve alcohol to anyone under the age of 21
- If someone has had too much to drink, have them spend the night or call a cab - don't let them drive home drunk.
- Make food and non-alcoholic drinks easily available.
- Provide plenty of food so the focus is not solely on alcohol. Food that has protein and fat - salt encourages more drinking and sugar does not mix well with alcohol
- Encourage games, prizes, and non-alcoholic beverages
- Provide limited tickets for an open bar
- Close the bar 90 minutes before the party has ended.
- Hire a cab company or limousine service
- Hire a bartender to serve the drinks
Having a plan will allow you to prevent problems from happening or a least, handle the problems before they occur and allow you to enjoy your own party!
